Summary of the action and settlement

The plaintiff alleges that the defendants are responsible for harm caused by construction defects and poor workmanship in the buildings. Occupants lost enjoyment of their condominiums during corrective work due to noise, dust, restricted access to certain rooms, loss of balcony use, privacy impacts, stress, and other issues.

The plaintiff and defendants negotiated and ultimately accepted the settlement after counsel for all parties thoroughly assessed the facts and law, taking into account the burden and costs of continued proceedings as well as litigation risk and uncertainty.

Although the defendants deny wrongdoing or liability, they agreed to settle the action to avoid litigation.

Settlement terms

Certain defendants agreed to pay a total of $800,000 (the “Settlement Amount”) to settle the action. If approved, the Settlement Amount will be allocated as follows:

• a) Compensate settlement class members who submit valid claim forms on time
• b) Pay settlement-related costs, including claim administration costs and class counsel fees (not exceeding $240,000 plus taxes, in addition to costs and disbursements)
• c) Pay the plaintiff an honorarium of $6,000 (subject to court approval)

Compensation will be paid only if the court gives final approval to the settlement and after appeal periods have expired and any appeals have been decided. Thank you for your patience.
